1. Introduction

These terms establish clear service expectations, customer responsibilities, liability limitations, software licensing compliance, and adherence to Vietnamese, Philippine, and global IT regulations.

📌 By requesting services from BigT Computer Services, the customer acknowledges and agrees to the provisions outlined in this agreement.

2. Services Provided & Limitations

BigT Computer Services offers professional IT solutions, including:

✔ Computer & Laptop Repairs – Diagnostics, software installation, and system optimization.
✔ Data Recovery – Secure restoration of lost files (subject to recovery success).
✔ Remote IT Support – Virtual troubleshooting via secure access tools.
✔ Technical Consulting – Tailored IT recommendations for businesses and individuals.

🚫 BigT Computer Services does NOT provide:
✖ Cybersecurity monitoring or penetration testing.
✖ Recovery of encrypted or password-protected files without valid credentials.
✖ Assistance with unauthorized software installations or piracy-related activities.
✖ Physical damage repairs involving motherboard soldering or chip replacements.

📌 All services are performed on a "best-effort basis." While we strive for success, outcomes may vary based on system condition and external factors beyond our control.

3. Compliance with Vietnamese, Philippine, and Global IT Regulations

BigT Computer Services operates in strict compliance with local laws in Vietnam and the Philippines while following global IT service standards to ensure legal, ethical, and secure practices.

Applicable Vietnamese Laws & Standards

✔ Vietnam Law on Cybersecurity (2018) – Ensuring customer data privacy and security in IT assistance, data handling, and business operations.
✔ Decree No. 53/2022/ND-CP – Compliance with data localization, securing customer-sensitive information, and restricting unauthorized data transfers.
✔ Vietnam Law on Information Technology (2006) – Compliance with IT service standards, software licensing requirements, and customer data protection.
✔ Circular No. 09/2020/TT-BTTTT – Responsible management of personal data protection in IT services.

Applicable Philippine Laws & Standards

✔ Data Privacy Act of 2012 (RA 10173) – Ensuring proper data collection, processing, and confidentiality for IT-related services.
✔ Cybercrime Prevention Act of 2012 (RA 10175) – Compliance with Philippine cybercrime prevention laws, including unauthorized access protections.
✔ Electronic Commerce Act of 2000 (RA 8792) – Legal compliance in handling IT transactions, digital records, and online payments.
✔ Republic Act No. 10844 – DICT Act of 2015 – Standardizing IT service practices and aligning with Philippine government regulations on information systems.

Applicable Global IT Compliance Standards

✔ ISO/IEC 27001 – Information Security Management – Best practices for securing customer data during IT support and data recovery.
✔ General Data Protection Regulation (GDPR) – Ethical handling of personal data under European data protection laws (if servicing clients abroad).
✔ Software Licensing & Copyright Compliance – Strict adherence to intellectual property laws governing software installations and technology services.

🚫 BigT will NOT accept service requests that violate Vietnamese, Philippine, or international data protection laws.

📌 Customers requesting software installations must provide verified licensing details to ensure regulatory compliance.

4. Software Licensing Requirements & Disclaimer

✔ BigT Computer Services only installs and supports legally licensed software.
✔ Customers must provide valid proof of purchase for any software requiring installation or troubleshooting.
✔ Unlicensed or pirated software will NOT be installed, serviced, or recovered under any circumstances.
✔ Customers acknowledge that any software licensing violations are solely their responsibility—BigT will not be liable for legal or financial consequences arising from improperly licensed software.

🚫 BigT will NOT support requests involving cracked software, unauthorized key activations, or circumvention of software restrictions.

📌 Customers are responsible for complying with software vendors’ licensing agreements before requesting installation or troubleshooting.

5. Payment Terms & Accepted Methods

✔ Customers must pay the agreed service fee upon service completion, unless otherwise agreed.
✔ Accepted payment methods: Cash or Bank Transfer (no third-party payment platforms).
✔ Pricing estimates are provided before work begins, but final pricing may vary based on complexity.

🚫 Refunds for unsuccessful data recovery are NOT guaranteed. Data recovery is performed on a best-effort basis.

📌 BigT is NOT responsible for banking errors, transaction failures, or financial discrepancies caused by external banking institutions.

6. Client Consent for Sensitive IT Tasks

Certain IT support tasks involve handling sensitive customer data, system modifications, or proprietary files. To ensure compliance, customers must explicitly consent before proceeding with these services.

✔ System Modifications & Upgrades: Customers must sign a consent form before making major system changes, such as BIOS updates, operating system reinstalls, or drive formatting.
✔ Data Recovery Authorization: Customers must verify data ownership and provide written authorization before proceeding with file recovery requests.
✔ Remote Access Permissions: Customers must manually grant access before allowing BigT to perform remote troubleshooting.
✔ Confidential Information Handling: Customers acknowledge that BigT will never retain, store, or share sensitive files beyond service completion.

🚫 BigT reserves the right to refuse IT support services if consent is not properly documented or customer verification is insufficient.

📌 Customers requesting sensitive IT tasks must sign a formal service authorization before proceeding.

7. Service Liability Waiver & Indemnification Clause

BigT Computer Services takes reasonable measures to provide safe and effective IT solutions. However, customers acknowledge inherent risks associated with IT troubleshooting, data handling, and system modifications.

🚫 BigT Computer Services is NOT liable for:
✔ Permanent data loss due to hardware failure, accidental deletion, or pre-existing system corruption.
✔ Security breaches caused by customer-installed third-party applications, weak passwords, or outdated software.
✔ Unintended consequences from system modifications requested by the customer.
✔ Issues resulting from third-party software defects, compatibility errors, or licensing restrictions.

📌 BigT reserves the right to terminate service agreements if customers fail to uphold security and data protection responsibilities.

8. Modification of Terms & Governing Law

✔ BigT reserves the right to modify these Terms & Conditions to comply with legal, security, or industry updates.
✔ Customers must review updates before requesting services.
✔ Continued use of our services indicates acceptance of updated terms.

📌 These terms are governed by Vietnamese and Philippine law. Disputes will be handled under local jurisdiction.
